Articles 32 and 226 lay a constitutional obligation on the Supreme Court and High Court to protect the fundamental rights of the people and for that purpose the courts have all incidental and ancilliary powers to forge new remedies and fashion new strategies designed to enforce the fundamental rights , particularly in the case of the poor and the disadvantaged who are denied their basic human rights and to whom freedom and liberty often have no meaning . अनुच्छेद 32 और 226 उच्चतम न्यायालय और उच्च न्यायालयों पर लोगों के मूल अधिकारों को संरक्षण प्रदान करने का संवैधानिक दायित्व डालते हैं और इस प्रयोजन के लिए न्यायालयों के पास मूल अधिकारों के प्रवर्तन के लिए , खासतौर से निर्धन और अलाभकर Zस्थितियों में जीने वालों के मामले में जो बुनियादी मानवाधिकारों से वंचित हैं और जिनके लिए स्वतंत्रता का प्राय : कोई अर्थ ही नहीं है , नए उपचार और नई युक्तियां विकसित करने की सभी प्रासंगिक एवं आनुषंगिक शक्तियां विद्यमान हैं .
